Anastasia Yaremchuk gave comments on the initiative of Ministry of Finance of Russia, aimed at preventing subsidiaries from participation in purchases.
Ministry of Finance proposed amendments to the law on contractual system (federal law № 44). These amendments will hinder businesses owned by offshore companies to participate in purchases. The office considers these businesses as trying to avoid taxes and to launder money.
Head of antitrust practice at RBS Anastasia Yaremchuk thinks that the proposed amendment may turn out to be as useless as the prohibition for the offshore companies to participate in state purchases introduced in 2015. According to Yaremchuk, if earlier such companies worked through their “daughters”, now they will work through their “granddaughters”.
